BA price-fixing fine overturned by EU court

A €104 million fine imposed on British Airways for alleged price fixing has been overturned by the General Court of the European Union.

BA was one of 11 airlines to be fined a total of €790 million by the Europan Commission in 2010 following an investigation into fuel and security surcharges.

The EC found the airlines were guilty of fixing prices for the carriage of freight.

However, the airlines contested that the EC had considered in its decision four different infringements relating to different routes and periods, but the fines were based on there being just one continuous, worldwide infringement.

The General Court agreed that the ruling was inconsistent and annulled most of the fines.

Qantas was the only airline that did not contest its €8.9 million fine, so the fine still stands.

The EC said it would examine the judgments and consider whether to appeal to the European Court of Justice.
