Theme park sues Taylor Swift in ‘evermore’ trademark row
A Utah theme park is annoyed at Taylor Swift’s latest album success.
Evermore Park is suing the pop diva, saying the hype behind her recent ‘evermore’ album release has kicked the theme park way down Google search results.
It is also claiming damages for trademark infringement as Swift is selling ‘evermore’ merchandise.
Evermore Park is a fantasy themed amusement park with knights and witches.
Park founder Ken Bretschneider claims Swift’s legal team had previously ignored a cease-and-desist letter.
The suit claims the album release caused ‘actual confusion’ with search volume for the album sending the theme park plummeting in search results.
The park is seeking $2 million in damages for each infringement of merchandise which is says amounts to product counterfeiting.
It is ‘incurring additional marketing and promotional costs to compete with the torrent of information related to the ‘evermore’ album and Taylor Swift.’
Swift’s lawyers call the suit ‘baseless’ and say the theme park has actually benefitted from the extra attention.
