Mum whose husband and children died in Spanish hotel pool may demand further tests
The woman whose husband and two children drowned in a swimming pool on the Costa del Sol on Christmas Eve could ask for further investigation into what happened, according to her lawyer.
Olubunmi Diya, whose husband Gabriel, 52, son Praise-Emmanuel, 16, and daughter Comfort, nine, has hired Spanish lawyer Javier Toro.
She disputes claims the deaths were a tragic accident and says reports the three were not able to swim are untrue.
She believes the deaths were caused by a fault with the pool and wants different engineers to carry out more tests.
The family, from London, were holidaying at Club La Costa World resort, near Fuengirola, when the accident happened at around 1.30pm local time on Christmas Eve.
Club La Costa World operator CLC World Resorts & Hotels said Mrs Diya’s claims are ‘directly at odds with the findings of the police report’ and ‘their exhaustive investigations have confirmed the pool was working normally and there was no malfunction of any kind’.
The company said: "Naturally we have heard the comments made on behalf of Mrs Diya in a widely publicised statement to the media.
"The claims made in that statement are directly at odds with the findings of the police report. This makes it clear that their exhaustive investigations have confirmed the pool was working normally and there was no malfunction of any kind.
"The police report containing full findings has been passed to us and also made public by the police…We would emphasise that these are findings of the police investigation and not our own internal findings as has been wrongly reported by some media.
"CLC can confirm that the pool remains closed out of respect to the victims of this tragedy and that guests have been, and are being, directed to other pools.
"Our sympathies remain with the family at what we understand must be a stressful and desperately upsetting time for them."
In an earlier statement, the company said: "The Guardia Civil have carried out a full investigation which found no concerns relating to the pool in question or procedures in place, which leaves us to believe this was a tragic accident which has left everyone surrounding the incident in shock.
"Naturally our primary concern remains the care and support of the remaining family members."
