Tui agrees to compensate holidaymakers
Tui UK has agreed to pay undisclosed damages to 98 Thomson clients who fell ill while staying at a hotel in Bulgaria.
A further 40 holidaymakers who stayed at the Rui Miramar hotel are still pursuing the operator for compensation.
Tui reached an out of court settlement earlier this week with four of the 138 holidaymakers who had been fighting a class action against the operator for five years.
The majority of claims had been settled a couple of months ago, but Tui confirmed today that 40 cases are still outstanding.
The holidaymakers became ill while staying at the Riu Mirmar hotel in July 2006 after heavy rains flooded the ground floor, leading to poor hygiene.
In a statement, the operator said: "The health and wellbeing of our customers is of paramount importance to Thomson.
"We are concerned to learn of any alleged illness or disappointment in any of our properties and can confirm that we no longer operate to the Riu Miramar.
"A number of the claims in the action are outstanding and as the matter in question is still currently subject to legal proceedings, it would be inappropriate of us to comment any further at this time so as not to prejudice future court decisions."
