The Supreme Court in Spain has ruled against Ryanair’s ‘unfair’ rules relating to the carriage of passengers’ baggage. In its conditions of carriage Ryanair states it can send bags on a different flight to the one a customer books but does not state for what reasons would apply.
The court said the airline’s clause doesn’t specify when checked baggage could be sent on a different flight, such as for safety or unforeseen operational reasons. The ruling followed a complaint from a consumer association.
"It is left to the will of the carrier to send the checked baggage on the same flight or not under … unspecified and absolutely unspecific circumstances of safety or operation," it said.
