B&B owners continue fight to identify TripAdvisor critics
B&B owners are taking their case against malicious TripAdvisor reviews to the Supreme Court.
The legal action is the last chance for Martin and Jacqui Clark, who took over the TIgh na Cheo guest house in Kinlochleven, Lochaber in 2011, and who have been battling to identify who wrote the ‘bogus’ reviews.
They want to know the identity of the reviewers, who wrote under pseudonyms, so that they can sue for defamation.
The latest move was made possible after an unidentified wealthy benefactor stepped in to fund the case, reports the Sunday Times.
The Supreme Court could issue a formal request for TripAdvisor to disclose the identity although the company would not be legally obliged to comply.
Previously the court of session in Edinburgh decided not to order TripAdvisor to identify who was behind the posts and this decision was upheld at appeal.
TripAdvisor has refused to co-operate arguing that any legal issues must be resolved in Massachusetts where its headquarters are.
Lawyers representing the couple, Bannatyne Kirkwood France and Co, said: "My clients are not going after TripAdvisor, but as (it is) a company which has a presence in the UK they find it unacceptable that TripAdvisor has consistently refused to remove eht false reviews, or to provide information on who posted them."
