Monarch administrators have been refused permission to appeal after losing a High Court battle over runway slots, but could still apply directly to the Court of Appeal.

Earlier this month the High Court ruled that Monarch has no right to take off and landing slots, which the airline’s administrators KPMG had hoped to sell to other carriers to raise money to pay off creditors.

KPMG’s lawyers argue the slots at Birmingham, Gatwick, Luton, Leeds-Bradford and Manchester airports for summer 2018 were the failed airline’s most valuable asset.

They are fighting a decision by Airport Co-ordination Ltd not to allocate certain slots to the airline for summer 2018.

But judges rejected Monarch’s claim that ACL was under a duty to allocate the slots to it ‘by reason of historical precedence’ and said they should be placed in the slot pool.

Although they refused a ‘stay’ on their order for the slots at Manchester and Birmingham airports, they granted one in relation to Gatwick and Luton.

That stay has now been extended until November 23.
