A Kuala Lumpur High Court has upheld a RM10 million fine imposed on Malaysia Airlines and AirAsia by the country’s Competition Commission.
A judge denied an earlier appeal ruling in favour of the airlines.
The airlines breached market-sharing prohibition under the Competition Act by entering into an agreement to share and not compete in certain markets.
Competition Commission first ruled against the airlines in 2014, and then two years later an appeal to set aside the fine of RM10 million each was successful by the carriers.
That has now been revoked by the High Court which also ordered AirAsia and MAS to pay court costs.
According to AirAsia’s legal counsel Leonard Yeoh the airline will again appeal.
