First lawsuit filed against MGM Resorts for Las Vegas shootings

The first lawsuit has been filed against MGM Resorts International over the Las Vegas music festival massacre, as the hotel company offered its own version of events leading up to the shooting.

The lawsuit, filed on behalf of injured California college student Paige Gasper, claims negligence by Mandalay Bay Hotel for failing to respond in a timely manner and for hotel staff failing to notice any suspicious behaviour in gunman Stephen Paddock in the days leading up to the attack.

This allowed Paddock ‘to commit a mass shooting unencumbered’ it claims.

The concert promoter Live Nation is also named as a defendant in the lawsuit.

Meanwhile MGM has issued its own timeline of events and says Paddock opened fire on a Mandalay Bay hotel security guard at about the same time or within 40 seconds of his shooting rampage at the concert crowd below.

It differs by several minutes to the revised timeline issued by Las Vegas police earlier this week.

“We are now confident that the time stated in this report is not accurate. We know that shots were being fired at the festival lot at the same time as, or within 40 seconds after, the time Jesus Campos first reported that shots were fired over the radio.

“We will continue to work with law enforcement as we have from the first moments of this tragedy as they work toward developing an accurate timeline,” MGM said.

If proved correct, that would have a major bearing on any legal action taken against MGM.

However, the company still faces questions of ‘whether reasonable precautions were in place’ said attorney Neama Rahmani, who is representing some of the victims.

Paddock killed 58 people and injured 489 in the 10-minute shooting spree.
