Legal bid to halt Stansted expansion flops

Tuesday, 3 December 20133 min read

A legal bid to halt the expansion of Stansted Airport has failed in the High Court.

The Stop Stansted Expansion group (SSE) threatened to delay the airport expansion after arguing that the criteria used to decide options for runway sites was "infected by apparent bias".

The group has already succeeded in removing Geoff Muirhead, former boss of Manchester Airports Group, from the commission over claims that he had a conflict of interest, see previous story.

But Mrs Justice Patterson ruled against SSE in deciding that no previous harm could have been done by Mr Muirhead, in terms of bias, during his involvement with the Commission from 2 November 2012 until his resignation on 20 September 2013.

Brian Ross, from SSE, told the BBC that members were discussing whether or not to appeal the decision.

A statement said: "Because there is so much at stake, and because the position is still not entirely satisfactory, SSE needs time to give proper consideration to the Judge’s (60-page) ruling and to discuss it in detail with its legal advisors before deciding whether there are aspects of the judgment that need to be taken to the Court of Appeal.

"In the meantime, SSE will be making no further comment."
