Los Angeles school kids sue Delta over jet fuel dumping incident
LA school students have joined teachers in suing Delta Air Lines after being showered with fuel last month.
Three students from Pioneer High School filed the suit alleging Delta was negligent and had no regard for the health of the local population.
The pilot was forced to dump thousands of gallons of fuel last month before an emergency landing back at Los Angeles International Airport.
The pilot didn’t inform air traffic control about the intended fuel dumping.
When this is needed, ATC would typically instruct the plane to a safe area, such as over the ocean, to dump the fuel, or ensure the plane is at an altitude where the fuel would vaporize before reaching the ground.
Local officials said 67 children and adults were treated after being exposed to the jet fuel on the street and in school yards.
Some were treated in hospital although all injuries were deemed to be minor.
"Delta and its flight crew were aware of or should’ve been aware that jet fuel is toxic and that contact is harmful and dangerous to humans. Delta was under a duty to adequately notify and communicate with air traffic control personnel of any need or intent to dump fuel," the lawsuit said.
It gave ‘no regard for the health and welfare of the populated areas below.’
It alleges ‘Flight 89 exposed the students and others in the highly populated area to the toxic jet fuel, which penetrated their skin, mouths and noses, causing itching, illness, nausea, dizziness and emotional distress.’
A few days after the incident four elementary school teachers filed a similar lawsuit alleging negligence by Delta.
