NY hotel hit with lawsuit over Legionnaires death
An upstate New York hotel is facing a lawsuit alleging negligence in the death of a guest who contracted Legionnaire’s Disease.
A lawsuit was filed against the Watkins Glen Harbor Hotel by the family of Vera E. DeWeese, who died in August 2018.
She had visited the hotel for a wedding and had used the pool and hot tub, the suit says.
Her cause of death was from sepsis due to Legionella Pneumonia.
It claims the hotel was ‘grossly negligent and reckless in its maintenance of its pool and hot tub.’
"The hotel employees charged with maintaining the pool and spa area and those that supervised them were not properly trained in pool and spa maintenance, including, but not limited to the administration of chemicals and testing of chemical levels," the suit alleges.
According to the complaint, the New York State Department of Health conducted inspections of the hotel’s swimming pool and spa facilities and found multiple violations of state health laws earlier in 2018.
The Health Department then warned of potential exposure to legionella bacteria in August 2018.
"In the days leading up to her death, DeWeese experienced significant pain and suffering, including, severe headaches, vomiting, diarrhoea, body pain, and anxiety," the lawsuit alleges.
DeWeese’s family is seeking compensation for wrongful death, negligence and pain and suffering.
